Disclaimer, Pricing and Order Review Policy

This Disclaimer, Pricing and Order Review Policy applies to purchases made through excellentphoto.ca and to product, pricing, promotional, inventory, and other information displayed by Excellent Photo.

In this policy, “Excellent Photo,” “we,” “us,” and “our” refer to the operator of excellentphoto.ca.

This policy is intended to explain our practices clearly. It does not limit any right or remedy that cannot legally be excluded, limited, or waived under applicable consumer-protection, contract, or other laws.

1. Product Information

We make reasonable efforts to ensure that product titles, descriptions, specifications, images, compatibility information, prices, availability, included accessories, and promotional details are accurate and current.

However, information displayed on our website may occasionally contain typographical errors, technical errors, supplier-feed errors, data-entry errors, omissions, inaccurate images, outdated specifications, or other inaccuracies.

Manufacturers and distributors may change product specifications, included accessories, packaging, firmware, colours, model numbers, country-specific configurations, warranty terms, or availability without notice. Product images are for illustration purposes and may not always show every included accessory or the exact current packaging.

Before placing an order, customers should review the product description, compatibility requirements, included items, and any stated conditions. Where a product’s compatibility is important to the intended use, the customer remains responsible for confirming compatibility with their own equipment or system.

2. Prices and Pricing Errors

Unless otherwise stated, prices on excellentphoto.ca are shown in Canadian dollars.

We work to ensure that prices are accurate. However, a price may occasionally be displayed incorrectly because of a typographical error, technical issue, supplier-feed issue, promotional setup error, currency or data error, system malfunction, or other unintended mistake.

Where a genuine pricing error is identified, we may correct the listing and remove or amend the incorrect price for future purchases.

For an order affected by a genuine and material pricing error, Excellent Photo may, to the extent permitted by applicable law:

  • contact the customer to explain the error and offer the option to proceed at the corrected price;

  • cancel the affected order and issue a full refund of amounts paid for that order; or

  • decline to complete the transaction where the error is identified before fulfillment and applicable law permits cancellation.

We will not charge a customer more than the applicable advertised price without the customer’s agreement, except where a correction is permitted by applicable law or the original displayed amount was an obvious and material error.

Prices, promotions, rebates, bundles, gifts with purchase, financing offers, and coupon codes may be changed or withdrawn for future purchases without notice, subject to applicable law. Changes will not retroactively alter a completed transaction except where legally permitted or where required to correct a genuine error.

3. Order Submission, Review and Fulfillment

Submitting an order through excellentphoto.ca creates a request to purchase the selected products. An automated order acknowledgment, payment authorization, order number, or email confirming receipt of an order confirms that we received the order; it does not by itself guarantee product availability, shipment, delivery date, or fulfillment.

Orders may be reviewed before fulfillment for inventory availability, pricing accuracy, payment authorization, fraud prevention, shipping restrictions, quantity limits, supplier restrictions, and other legitimate operational or legal reasons.

Excellent Photo reserves the right, where permitted by applicable law, to decline, cancel, limit, or modify an order before shipment where:

  • a genuine pricing, promotion, product-description, inventory, or technical error affected the order;

  • the item is unavailable, oversold, discontinued, restricted, or cannot reasonably be obtained from the supplier;

  • the order contains inaccurate or incomplete customer, payment, or shipping information;

  • there is a reasonable concern regarding fraud, payment security, resale, export, sanctions, compliance, or unauthorized use of a promotion;

  • a stated quantity limit, eligibility condition, or supplier/manufacturer restriction applies; or

  • fulfillment would otherwise violate applicable law or a disclosed order condition.

Where we cancel an order after payment has been collected, we will refund the amount paid for the cancelled item or order to the original payment method, subject to payment-provider processing times.

Nothing in this section is intended to deny that a contract may be formed at an earlier point where applicable law provides otherwise. The legal status of an order and the rights of both parties are determined by applicable law and the circumstances of the transaction.

4. Availability and Inventory

Product availability shown online is an estimate and is not a guarantee of immediate availability.

Inventory can change quickly because of in-store sales, online sales, supplier availability, warehouse adjustments, manufacturer allocations, discontinued products, shipping delays, inventory-sync delays, or other circumstances.

A product shown as “In Stock,” “Available,” “Low Stock,” “Special Order,” “Preorder,” “Backorder,” or available for pickup may become unavailable before fulfillment.

Where an item becomes unavailable, we may offer the customer a reasonable alternative, a revised estimated delivery date, or a refund. We will not substitute a different product without the customer’s consent.

5. Special Orders, Preorders and Backorders

Products identified as special order, preorder, backorder, supplier order, or otherwise not immediately available may be subject to longer processing times, manufacturer allocations, supplier restrictions, and estimated dates that may change.

Any estimated arrival date, shipping date, availability date, or delivery date is an estimate unless we expressly confirm otherwise in writing.

A supplier or manufacturer may delay, limit, reallocate, discontinue, or cancel an item after an order is submitted. If we cannot reasonably supply an item, we may cancel the affected order and refund amounts paid, subject to applicable law.

Special-order, preorder, customized, or non-returnable products may be subject to additional terms disclosed before purchase. Those terms apply only to the extent permitted by applicable law.

6. Promotions and Offers

Promotional pricing, coupon codes, manufacturer rebates, bundles, gifts with purchase, trade-in offers, and financing offers are subject to the specific terms displayed with the offer.

Unless expressly stated otherwise, promotions are available while supplies last and may be limited by product, quantity, customer, region, shipping destination, payment method, or time period.

We may correct, suspend, or withdraw a promotion for future transactions where there is a genuine error, technical issue, abuse, supplier restriction, or legal requirement. We will not retroactively remove a properly earned promotional benefit from a completed transaction except where permitted by law or necessary to correct a genuine error.

7. Taxes, Shipping, Duties and Charges

Applicable sales taxes are calculated based on the relevant shipping or pickup location.

Shipping costs, insurance, environmental fees, recycling fees, duties, brokerage fees, tariffs, customs charges, and other charges will be disclosed where applicable before the customer completes the purchase, or otherwise as required by law.

For shipments outside Canada, the recipient may be responsible for customs duties, taxes, brokerage charges, import requirements, and other fees imposed by the destination country, carrier, or customs authority, unless expressly stated otherwise.

Excellent Photo is not responsible for delays, refusals, seizures, charges, or delivery issues caused by customs authorities, carriers, export controls, import restrictions, or destination-country requirements that are outside our reasonable control.

8. Website and Technical Errors

We take reasonable steps to maintain the availability and accuracy of excellentphoto.ca. However, the website may occasionally be affected by system interruptions, incorrect information, inventory-sync delays, browser issues, payment-provider issues, third-party service outages, or other technical problems.

We may correct, update, suspend, remove, or modify website content, product information, prices, promotions, and functionality as needed for future transactions.

Nothing in this policy excludes responsibility where it cannot legally be excluded under applicable law.

9. Consumer Rights and Legal Warranties

For consumers in Quebec, the Consumer Protection Act, the Civil Code of Québec, and other applicable laws may provide mandatory rights, remedies, and legal warranties.

For consumers elsewhere in Canada, applicable federal, provincial, or territorial laws may provide mandatory rights and remedies.

Nothing in this policy is intended to exclude, restrict, or waive any legal warranty, consumer remedy, statutory protection, or other right that cannot legally be excluded, restricted, or waived.

Where there is a conflict between this policy and mandatory applicable law, the mandatory law will prevail.

10. Language

This policy is available in English and French. For Quebec consumers, contracts, notices, and related documents will be provided in accordance with applicable Quebec language laws.

Where both English and French versions are provided and there is a discrepancy, the version or interpretation required by applicable law will prevail. Where the law requires an interpretation favourable to the consumer, that requirement will apply.

11. Governing Law

For transactions with Quebec consumers, this policy and the related transaction are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable in Quebec, without limiting mandatory consumer protections that may apply.

For consumers outside Quebec, applicable mandatory laws of the consumer’s province or territory may also apply.

12. Changes to This Policy

We may update this policy from time to time for future transactions. Any update will be posted on excellentphoto.ca with a revised “Last updated” date.

Updates will not retroactively change the terms of an order already entered into, except where permitted or required by applicable law.
